Application to Vary Condition 4 (Hours of Working) of Planning Permission 22/00174/CMAS at Nursling Recycling Facility, Lee Lane, Nursling Southampton SO16 0AD (No. 25/01225/CMAS) TV055
The Committee received a report from the Director of Universal Services concerning an application for variation of condition 4 (hours of working) at Nursling Recycling Facility to allow a total of six HGV in and out movements on Public Holidays (not including Christmas Day and Boxing Day). The rationale behind the proposed variation was that it was needed to facilitate the waste collection arrangements of Southampton City Council, namely the transfer and disposal of residual waste collected by the Commercial Waste Services.
Officers summarised the report, sharing details of the location of the site alongside site plans, photos of the area and details of consultations and representations.
Three deputations were received from the following in opposition to the recommendation to the committee:
· A local resident, Parish Councillor and Secretary of Old Nursling Residents Association,
· The Clerk to Nursling Parish Council,
· Cllr Phillip Bundy, Planning Portfolio Holder at Test Valley Borough Council.
During the above deputations letters from other residents and a written submission from Councillor Nick Adams-King was read in opposition to the recommendation.
A deputation was also received from the applicant in favour of the recommendation.
During questions to officers, it was clarified that:
· Officers consider the need for the request to have been demonstrated by the applicant and the number of vehicle movements requested to not be unreasonable.
· The application was for the transport of waste materials and not for any processing to occur on these days.
During debate, members raised concerns relating to the need to balance the need of the applicant with the impact to the residents, with consideration to the existing traffic and the importance of public holidays.
Following a summary, the Chairman moved to the recommendations which was voted on with the following outcome:
Favour: 3
Against: 12
Abstentions: 0
Members then provided their reasons to Officers for the refusal as set out below, and agreed these reasons by a vote with the following outcome:
Favour: 12
Against: 2
Abstentions: 1
RESOLVED:
That planning permission be REFUSED due to the following reasons:
No additional waste capacity will be generated and no need for the development has been demonstrated to the extent it outweighs the disbenefits of the development (Policy 27 (Capacity for waste management development) of the Hampshire Minerals and Waste Plan (2013)).
The development would have an unacceptable adverse amenity impact to residents along the highway route to the site due to noise and dust generation contrary to Policies 10 (Protecting public health, safety and amenity), 12 (Managing traffic) and Policy 25 (Sustainable waste management) of the Hampshire Minerals & Waste Plan (2013)), and Policy LHW4 (Amenity) of the Test Valley Local Plan (2016).
The development is, therefore, not considered to be a sustainable development and on balance is not in accordance with Policy 1 (Sustainable minerals and waste development) of the Hampshire Minerals & Waste Plan (2013).
