Minutes REVISED APPLICATION - Retrospective planning application for the change of use to open storage of recycled aggregate materials; the retention of ancillary office, workshop and hardstanding; and associated works at Shedfield Equestrian Centre, Lockhams Recycling Ltd, Botley Road. Shedfield Hampshire SO32 2HN (No. 24/00807/HCS) WR228

The Committee received a report from the Director of Universal Services concerning a planning application seeking retrospective planning permission for the open storage of recycled aggregate materials and the retention of ancillary office and workshop and associated works. This application followed the refusal of planning application 22/02015/HCS on 24 January 2024 for the same proposal at the application site. It also followed the deferral of this item from the October 2024 Regulatory Committee.

Officers summarised the report, sharing details of the location of the site alongside site plans, photos of the area and details of consultations and representations. Officers noted that objections had been received from Winchester City Council and Shedfield Parish Council.

Deputations were received from a local resident, Joanna Harvey, Cllr Vivian Achwal from Winchester City Council and Francesca Byrne and Ian Donohue from Shedfield Parish Council and Southern Planning Practice (respectively) in opposition to the recommendation to the committee. In addition, a written submission from Councillor Malcolm Wallace, was read in opposition to the recommendation.

During questions to officers, it was clarified that:

· This application for storage was separate to the neighbouring area currently in use as a waste recycling site, which benefits from a Certificate of Lawful Existing Use or Development (CLEUD). Officers noted that no restrictions could be provided relating to this site as part of this application and they could not form part of the decision making process for the current application.

· Neither the Environment Agency not Winchester City Council’s Environmental Health Officer (EHO) had any concerns or objections in relation to noise or dust/air quality emissions. The EHO had recommended conditions controlling noise and dust suppression be imposed as well as one restricting operating hours too, should permission be granted.

· Despite suggestions, there appears to have been no current liaison between the applicant and the local community.

During debate, members raised concerns relating to the location and need of the site. Members also noted the enforcement actions undertaken by the City Council on wider planning matter at the site. The lack of liaison with the community was highlighted, however it was noted that this could not impact or be a material consideration of the decision taken. The issues raised in relation to the health impact of local residents was also discussed.

Following a summary, the Chairman moved to the recommendations. Cllr Taylor proposed an additional condition as set out below, which was seconded by Cllr Withers and unanimously agreed to form part of the substantive recommendation.

‘No vehicle shall leave the site unless its wheels and chassis have been cleaned sufficiently to prevent mud being carried onto the highway. All HGVs vehicles shall be sheeted to prevent material being spilt onto the road.’

The reason provided for this was in the interest of highway safety and to ensure the development is in accordance with Policy 12 (Managing traffic) of the Hampshire Minerals & Waste Plan (2013).

Cllr Parker then proposed an amendment to Condition 16 as set out below, which was seconded by Cllr Meenaghan and unanimously agreed to form part of the substantive recommendation.

‘Not later than three months following the grant of planning permission, a plan detailing methods for the removal of all waste materials or products, the removal of all buildings, fencing, plant, machinery, structures and equipment (required to undertake permitted operations) and details on how the site would be restored to its original condition or to a condition acceptable to the Minerals and Waste Planning Authority should be submitted to the Minerals and Waste Planning Authority for written approval. Once approved, the plan shall be implemented in full within three months of the permitted use ceasing.

No vehicle shall leave the site unless its wheels and chassis have been cleaned sufficiently to prevent mud being carried onto the highway. All HGVs vehicles shall be sheeted to prevent material being spilt onto the road.’

The reason provided for this was in the interest of highway safety and to ensure the development is in accordance with Policy 12 (Managing traffic) of the Hampshire Minerals & Waste Plan (2013).

The amended recommendation was then voted on with the following outcome:

Favour: 7

Against: 9

Abstentions: 0

Members then provided their reasons to Officers for the refusal as set out below, and agreed these reasons by a vote with the following outcome:

Favour: 11

Against: 2

Abstentions: 3

RESOLVED:

That planning permission be REFUSED due to the following reasons:

1. On the basis of the information submitted, the location of the proposal has not been adequately justified in terms of its demonstrable market need for being located in this countryside location, and is contrary to the requirements of Policies 5 (Protection of the countryside) and 29 (Location of waste management development) of the Hampshire Minerals & Waste Plan (2013), Policy MTRA4 (Development in the Countryside) of the Winchester City Council Local Plan Part 1 – Joint Core Strategy (2013)) and Policy DM10 (Essential Facilities and Services in the Countryside) of Winchester City Council Local Plan Part 2 (2017);

2. It is considered that the proposal is likely to result in an unacceptable impact on the character of this rural locality, and is contrary to the requirements of Policies 5 (Protection of the countryside), 10 (d) (Protecting public health, safety and amenity) and 13 (High quality design of minerals and waste development) of the Hampshire Minerals & Waste Plan (2013), Policy CP13 (High Quality Design) of the Winchester City Council Local Plan Part 1 – Joint Core Strategy (2013) and Policy DM23 (Rural Character) of the Winchester City Council Local Plan Part 2 (2017).
