Notes to applicant:

1.

In reaching this decision Test Valley Borough Council (TVBC) has had regard to the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. TVBC work with applicants and their agents in a

positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions.

2.

The effect of Paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the biodiversity gain condition”) that development may not begin unless:

A Biodiversity Net Gain Plan and/or Habitat Management and Monitoring Plan has been submitted to the planning authority, and the planning authority has approved the plan. The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan if one is required in respect of this permission would be Test Valley Borough Council. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. However, based on the information available this permission is one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply.

Extension and conversion of existing garage to form ancillary accommodation

AMENDMENTS

None

CASE OFFICER

Tahira Waleed

The Officer’s recommendation, as per the agenda, was proposed by Councillor M Cooper and seconded by Councillor A Dowden. Upon being put to the vote the motion fell. Refusal was proposed by Councillor A Dowden and seconded by Councillor Gwynne. Upon being put to the vote the motion was carried.

REFUSED for the following reasons:

2.

The benefits of the scheme including the introduction of ancillary accommodation for the applicant’s elderly and vulnerable relatives is noted, however the proposed ancillary accommodation could be provided without resulting in the identified harm. The identified harm is real and permanent harm and the benefits do not therefore out weight the harm.
