In reaching this decision Test Valley Borough Council (TVBC) has had regard to the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. 2.

The water supply to the proposed development is classified as a Further Distribution System (also referred to as an Onward Distribution System) and is subject to Regulation 8 of the Private Water Supplies (England) Regulations 2016 (as amended). This is subject to regulation by Test Valley Borough Council. The expansion of such a supply may be in contravention of The Water Industry Act 1991 and advice should be south from the primary water supplier (Bournemouth Water). Notwithstanding the previous point, if the Further Distribution System is to be expanded, any products or substances utilised on the supply network must comply with Regulation 5 of the above regulations in order to prevent a detrimental effect on the safety or quality of drinking water. Further information on regulation 5 can be found on the Drinking Water Inspectorates website via the following link: http://dwi.gov.uk/private-water-supplies/guidance-documents/pws-regulations/information-note-on-regulation-5/ where expansion of onward distribution system occurs, at the point of use the effectiveness of treatment applied to the mains water may be reduced, again advice should be sought from the mains water supply company. Further guidance on regulation 8 supplies can be found on the Drinking Water Inspectorates website via the following link: https://dwi.gov.uk/private-water-supplies/guidance-documents/pws-regulations/information-note-on-regulation-8-revised-version/

3.

The effect of Paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the biodiversity gain condition”) that development may not begin unless:

A Biodiversity Net Gain Plan and/or Habitat Management and Monitoring Plan has been submitted to the planning authority, and

The planning authority has approved the plan.

The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan if one is required in respect of this permission would be Test Valley Borough Council. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. However, based on the information available this permission is one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply.
