Notes to applicant:
1.
In reaching this decision Test Valley Borough Council (TVBC) has had regard to the National Planning Policy Framework and takes a positive and proactive approach to development proposals focused on solutions. TVBC work with applicants and their agents in a positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions.
2.
The effect of Paragraph 13 of Schedule 7A of the Town and Country Planning Act 1990 is that planning permission granted for the development of land in England is deemed to have been granted subject to the condition (“the biodiversity gain condition”) that development may not begin unless:
A Biodiversity Net Gain Plan and/or Habitat Management and Monitoring Plan has been submitted to the planning authority, and the planning authority has approved the plan. The planning authority, for the purposes of determining whether to approve a Biodiversity Gain Plan if one is required in respect of this permission would be Test Valley Borough Council. There are statutory exemptions and transitional arrangements which mean that the biodiversity gain condition does not always apply. However, based on the information available this permission is one which will require the approval of a biodiversity gain plan before development is begun because none of the statutory exemptions or transitional arrangements are considered to apply.
3.
The applicant is reminded that, under the Conservation of Habitats and Species Regulations 2017 (as amended) and the Wildlife and Countryside Act 1981 (as amended), it is an offence to (amongst other things): deliberately capture, disturb, injure, or kill great crested newts; damage or destroy a breeding or resting place; intentionally or recklessly obstruct access to a resting or sheltering place. Planning permission for a development does not provide a defence against prosecution under this
legislation. Should great crested newts be found at any stage of the development works, then all works should cease, and a professional and/or suitably qualified and experienced ecologist (or Natural England) should be contacted for advice on any special precautions before continuing, including the need for a licence.

2.
The proposal falls within the BNG exemption criteria as outlined within Schedule 71 of the Town and Country Planning Act 1990 (as inserted by Schedule 14 of the Environment Act 2021), as the development affects less than 25sqm of on-site habitat.
3.
Bats and their roosts receive strict legal protection under the Wildlife and Countryside Act 1981 (as amended) and the Conservation of Habitats and Species Regulations 2017. All work must stop immediately if bats, or evidence of bat presence (e.g. droppings, bat carcasses or insect remains), are encountered at any point during this development. Should this occur, further advice should be sought from Natural England and/or a professional Ecologist.
4.
Birds’ nests, when occupied or being built, receive legal protection under the Wildlife and Countryside Act 1981 (as amended). It is highly advisable to undertake clearance of potential bird nesting habitat (such as hedges, scrub, trees, suitable outbuildings etc.) outside the bird nesting season, which is generally seen as extending from March to the end of August, although may extend longer depending on local conditions. If there is absolutely no alternative to doing the work during this period then a thorough, careful and quiet examination of the affected area must be carried out before clearance starts. If occupied nests are present then work must stop in that area, a suitable (approximately 5m) stand-off maintained, and clearance can only recommence once the nest becomes unoccupied of its own accord.
5.
It should be noted that it is an offence to kill, injure or disturb protected species, their nest sites and/ or shelters. It is also an offence to block access routes to areas of shelter/ nests used by wildlife, including within buildings (see the Wildlife and Countryside Act (1981) as amended, and the Conservation of Habitats and Species Regulations (2017)). It is recommended that any excavation works required within the development will be covered over night and any open pipework with an outside diameter greater than 150mm shall be covered at the end of each working day to prevent nocturnal mammals falling in and becoming trapped. Alternatively a suitable ramp should be provided within excavations, or the excavation battered, to allow trapped animals to escape.
6.
The occupants are advised to sign up to the Environment Agency Floodline Alert Direct service.
