PERMISSION subject to:

1.

The development hereby permitted shall be begun within three years from the date of this permission.

Reason: To comply with the provision of Section 91 of the Town and Country Planning Act 1990 as amended by Section 51 of the Planning and Compulsory Purchase Act 2004.

Notes to Applicant:

TVBC work with applicants and their agents in a positive and proactive manner offering a pre-application advice service and updating applicants/agents of issues that may arise in dealing with the application and where possible suggesting solutions.

2.

The effect of paragraph 13 of Schedule 7A to the Town and Country Planning Act 1990 is that Test Valley Borough Council is required to determine if planning permission granted for development of land in England falls under any statutory exemptions and transitional arrangements such that the mandatory biodiversity gain condition would not apply. Based on the information available this permission is considered to be one which will not require the approval of a biodiversity gain plan before development is begun because it represents a householder application

AMENDMENTS

· ‘Land Adjacent to 11 Ox Drove, Andover Noise Impact Assessment’, prepared by Clarke Saunders Acoustics, dated 20 November 2025.

· ‘Ground Condition Desk Stop Study’, prepared by Ground Condition Consultants Ltd, dated November 2025.

CASE OFFICER

Leigh Clutterbuck-Young

The motion as set out in the agenda was proposed by Councillor Budzynski and seconded by Councillor Neal. Upon being put to the vote the motion fell.

A motion for refusal was proposed by Councillor Donnolly and seconded by Councillor Borg Neal. Upon being put to the vote the motion was carried.

REFUSED for the reason:

The proposal by virtue of the density of development and the fact the development is formed in depth relative to Ox Drove and that these dwellings would be located on rising land south of Ox Drove, is unacceptable. The character and appearance of the southern side of Ox Drove mainly comprises a mix of frontage development and low density housing. This development is contrary to that prevailing character adversely affecting the character and appearance of that part of Ox Drove, when viewed from Ox Drove. As a result, and whilst recognising the economic benefits of construction jobs being created by the development, and the social benefits of delivering housing against a significant housing shortfall in the Borough, these benefits are significantly and demonstrably outweighed by the adverse effect of the proposal on the character and appearance of the area. The proposal does not comprise sustainable development and is contrary to Policy E1 of the Test Valley Borough Revised Local Plan (2016) and paragraph 12D of the National Planning Policy Framework.
