Minutes
Consideration was given to a report of the Head of Legal and Democratic Services which sought consideration of the Statement of Licensing Policy setting out how it would deal with its responsibilities under the Licensing Act 2003. The Policy was last considered in 2021 and must be reviewed and republished every 5 years and a draft revised Policy was published for consultation in July 2025 and attracted no responses.
The Council is legally required to consult upon its Licensing Policy. The lack of any substantive responses to the consultation would indicate that there is general satisfaction with the proposed Policy. Should, after its adoption, the Council consider it appropriate to review the Policy then the facility to do so is available.
Councillor Donnelly proposed and Councillor P Lashbrook seconded the motion as set out in the agenda. Upon being put to the vote the motion was carried.
Recommended to Council:
1. That the revised Statement of Licensing Policy published for consultation in July 2025 be recommended for approval by Council, subject to the revisions set out in this report.
2. That the revised Statement be effective for a five-year period commencing 7 January 2026 subject to the Policy being kept under review and the Council making such revisions to it at such times as it considers appropriate.

Minutes
Consideration was given to a report of the Head of Legal and Democratic Services which set out the requirement to formally adopt a Pavement licensing regime and associated provision.
Prior to 2020 premises providing refreshment could apply for a licence under the Highways Act 1980 to place tables and chairs on the highway/pavement adjacent their premises. The application process involved a 28-day consultation period and each application attracted a fee of £199. As a response to Covid, the Business and Planning Act 2020 (BPA) introduced an alternative fast-track procedure for a similar type of licence to aid business recovery from the impacts of Covid. The legislation was temporary and renewed annually until last year when made permanent by the provisions of the Levelling Up and Regeneration Act 2023 (LURA).
There is an imperative to agree a new Pavement Licensing regime and enable the efficient administration of the licensing functions of the Council following legislative changes introduced by the LURA and importantly to ensure the Council can respond to local businesses who are applying for such licences.
Councillor Donnelly proposed and Councillor Budzynski seconded the motion as set out in the agenda. Upon being put to the vote the motion was carried.
Recommended to Council:
1. That the Powers and Duties of the Licensing Committee be amended as set out in Annex 1 to the report.
2. That the delegations to the Head of Legal and Democratic are amended to grant, with or without conditions, or refuse applications for a Pavement Licence in accordance with the Business and Planning Act 2020, including the taking of enforcement action.
3. That the standard term of a licence be two years.
4. That no fee be charged for a Pavement Licence.
5. That where an application is refused, the applicant has the option to appeal that decision to the Licensing Committee as set out in the Licensing Procedures (Pavement Licences) at Annex 2 to the report.
