The Committee considered the report set out on pages of 15 of 106 of the agenda with the further material set out on the addendum sheet and other matters discussed at the meeting.
The Committee discussed the proposed application and highlighted that the site was located outside of the settlement policy boundary (SPB) and was not included in the approved Local Plan or the emerging Local Plan.
Members mentioned the planning history of the site. Application Number 20/02375/OUT for outline planning with all matters reserved except access for 75 dwellings, open space, allotments, landscaping and access via Sheep Fair Lane was refused at the Development Control Committee and Dismissed at appeal by the Inspector. Members considered that the Inspectors comments were relevant to the proposed application for 130 dwellings. As they believed that the development would not integrate well with the settlement of Overton in visual terms and would have an adverse impact on the landscape character and visual quality leading to encroachment into the countryside. It was generally considered that the proposed application was contrary to Local Plan Policy EM1.
Some Members expressed their concern over the additional vehicles as they considered that the site was not sustainable.
Members did not approve of turning the countryside which was a natural environment into a country park.
Members were concerned on the environmental impacts of the development on the Barn Owls and Skylarks which conflicted with Local Plan Policy EM4.
It was acknowledged that the proposed application had a provision of 40% affordable housing which was considered a benefit of the scheme.
The Committee considered the current position of the Boroughs 5-year housing land supply in their deliberations.
RESOLVED that: the application be REFUSED for the following reasons:
Reasons for Refusal
1 The proposed development would encroach into the countryside contrary to Policies SS1 and SS6 of the Basingstoke and Deane Local Plan 2011-2029. The intrinsic character of the countryside would be adversely impacted by virtue of its location and size extending further south of Overton on rising land. The proposed development would result in the loss of an area of undeveloped countryside that would significantly impact on the setting of the Village of Overton, adversely impacting on the local landscape character and scenic quality. The proposed development would not successfully integrate with surrounding development resulting in significant and adverse impacts on the visual quality of the area. It is not considered that this harm could be adequately mitigated against with the proposed open space creating a man made character compared to the rural nature of the land at present. The proposal is therefore contrary to Section 15 of the National Planning Policy Framework (December 2024) and Policies EM1 and EM10 of the Basingstoke and Deane Local Plan 2011-2029 and Policy LBE1 of the Overton Neighbourhood Plan (2016). The harm identified would significantly and demonstrably outweigh the benefits of the scheme contrary to paragraph 11d ii) of the National Planning Policy Framework (December 2024).
2 In the absence of any suitable legal agreement, or justification for the absence of a legal agreement, the proposed development does not make adequate provision for community and infrastructure contributions or provision in relation to affordable housing; equipped play areas; active travel connections and contributions towards active travel improvements, delivery of on-site open space and kick about space and accessible natural green space; landscape management plan, Biodiversity net gain, public art scheme contributions, Travel Plan and contributions to the maintenance and upgrading of the public right of way and an employment skills plan. The proposed development is therefore contrary to the Community Infrastructure Levy Regulations 2010 (as amended), Policies CN1, CN6, CN8, CN9, EM1, EM4 and EM5 of the Basingstoke and Deane Local Plan 2011-2029), Policies LBE1, H1 and H3 of the Overton Neighbourhood Development Plan 2016-2020 and the guidance contained within the Planning Obligations for Infrastructure Supplementary Planning Document (March 2018) and the National Planning Policy Framework (2024).
