Minutes In the matter of: Licensing Act 2003 - Application for a premises licence - The Coffee Quarters, Trinity House, Royal Haslar Waterfront Village, Gosport, PO12 2FB

All parties shall receive written notification of this decision.

Decision

The Sub Board has considered very carefully the application for a premises licence at The Coffee Quarters. It gave due regard to the Licensing Act 2003, the Licensing Objectives, statutory guidance and the adopted statement of licensing policy.

The Sub Board considered the relevant representations, both written and given at the hearing, by all parties. Human rights legislation and the public sector equality duty has been borne in mind whilst making the decision.

The application relates to cafe premises and is for the provision of retail sale of alcohol (on and off premises). The application indicates that the sale of alcohol is proposed between 09:00 hours and 17.00 hours every day of the week.

The application has generated representation from 2 residents, citing the following issues of concern:

- An increase in commercial use of the site with the number of covers, scope of outdoor use continuing to expand

- Anticipated increase in antisocial behaviour

- The distance required to walk to the premises will encourage car use

- A lack of CCTV coverage

- Hours applied for not matching current operation (particularly including Sundays) and are not needed / necessary

- Inappropriate or lack of bin storage currently

- Additional likely litter and nuisance from disposal of bottles etc.

For the premises the following points were raised or noted by the Sub Board from written representation:

- The applicant has proposed various conditions (through their operating schedule) - e.g. staff training and other conditions had been agreed with the police including, in particular, CCTV provision

- The police have not objected to the application

- Environmental health have not objected to the application

- A lack of objection must be interpreted as endorsement

- Alcohol will not be the main focus of the business but an accompaniment to the café business

- The premises is a family-oriented business

- The licence (rental agreement) for the premises restricts use to 9am to 5pm so evening events will not happen

- A challenge 25 policy will be implemented

- As the business only operates between 09.00 and 17.00hrs the risk of public nuisance is minimal.

- Noise levels will be monitored and customers encouraged to respect neighbouring residents.

- Litter will be collected regularly.

- The premises already sells a large amount of soft drinks in bottles and alcohol genuinely isn’t expected to add significantly to noise if at all.

- The premises hopes to re-open on Sundays during the winter months.

After having heard all of the above evidence the Sub Board determined to grant the proposed application, subject to the conditions proposed by the applicant and agreed with the police in advance of the hearing.

Reasons

The Sub Board accepted legal advice that commercial need or demand were not relevant to the licensing objectives and could not be taken into account.

The Sub Board has to balance the interests of the proposed business as set out in the operating schedule and clarified during the hearing and the rights of residents living in close proximity. The conditions imposed were considered appropriate given the potential for a business serving alcohol to cause nuisance is limited in this case to the relatively restricted hours of operation.

Residents can be reassured that in the event that the premises does change in nature or operate in a manner that undermines the licensing objectives and relevant evidence supports it, the premises licence may be brought back before the Licensing Committee for review. Steps can be implemented at that stage including additional conditions or restrictions or indeed revocation of the licence in extreme cases and where proportionate and appropriate.

There is a right of appeal for all parties to the Magistrates' Court, formal notification of the decision will set out that right in full.

RESOLVED: That the licence be granted
